The Company’s Liability
(a) Participants (a) To the extent permitted by law, the Company excludes liability and will not be responsible for any loss, damage or injury arising from or connected with the tour, no matter how that loss, damage or injury is caused. In particular, the Company will not be responsible for loss or damage arising from a Participant's failure to obey the Company guides’ instructions or from any pre-existing medical or psychological condition. Further, but only to the extent permitted by law, the Company will not be responsible for loss or damage arising from any negligent act or omission of the Company or any person for whom the Company is responsible. Certain laws imply non-excludable conditions and warranties. This provision does not exclude those conditions and warranties but limits the Company’s liability in relation to these to provision of services provided by the Company again, or refund of the cost of those services. We will not divulge your information to any third party unless where required for the purposes of providing your tour service. We will never sell personal information to any group or party for the purposes of advertising or spamming General Conditions
Our tours can run even with a minimum of one person but a minimum group payment is required. The tours run for 2 hours to 2.5 hours depending on individual requirements and are set at a relaxed pace for approximately 2 kilometers The tours are correct at the time of printing. The operator reserves the right to amend the itinerary due to unforseen circumstances (e.g. extreme weather) without notice. Every endeavour will be made to keep to arrival and departure times, however they are indicative only and no guarantee can be made and no compensation shall be payable in the event of loss due to missed connections. The safety of all clients is a high priority and Colonial Walk Agra Tours guarantees compliance with laws pertaining to conduct as a tour operator and observance of duty of care. Clients are to show diligence and their own duty of care and follow directions of the tour guide at all times. TCWA shall not be responsible for the liable death of or illness/injury to any person or loss of or damage to any property or otherwise however caused.
